These Terms & Conditions ("Terms") govern your access to and use of the Visbloom website and services at visbloom.com (the "Service"). By creating an account or purchasing on Visbloom, you agree to these Terms. If you do not agree, do not use the Service.
1. About Visbloom
Visbloom is an online marketplace offering original, AI-crafted stock imagery and video for licensing. The Service is operated by Miravio OÜ, a private limited company registered in Estonia. Prices are shown in euro (EUR) and Polish złoty (PLN); the underlying accounting currency is EUR.
2. Accounts
To purchase and download content you must register an account with a valid email address and accurate personal details. You are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old, or the age of majority in your country, and able to enter into a binding contract. Notify us at info@visbloom.com of any unauthorised use.
3. Credits & pricing
Visbloom uses a prepaid credit system. You add funds ("top up") in EUR or PLN, which are converted into credits at the rate of 100 credits = €1. Credits are used to purchase downloads; each item shows its price in credits. Credits have no cash value except as expressly set out in our Refund Policy, are non-transferable between accounts, and are not a payment instrument, deposit, or e-money.
Payments are processed by third-party payment service providers. We do not store your full card or bank details. You warrant that any payment method you use is your own and that you are authorised to use it.
4. Purchases & delivery
When you buy an item, the credit price is deducted from your balance and the file is made available for immediate download from your account's download history. Delivery is electronic only; no physical media is provided. A purchase grants you the licence described below — you are licensing the content, not buying the copyright.
5. Content licence
Subject to your compliance with these Terms and payment of the applicable credits, Miravio OÜ grants you a worldwide, perpetual, non-exclusive, non-transferable, non-sublicensable licence to use each downloaded image or video (the "Content") for:
- digital and printed marketing, advertising and promotional materials;
- websites, apps, social media, presentations and documents;
- editorial, educational and commercial projects;
- products or packaging where the Content is not the primary value being resold.
The licence takes effect once the item is downloaded and the credits are deducted. It is watermark-free and does not expire.
6. What you may not do
You may not:
- resell, sub-license, redistribute or share the Content as a stand-alone file, or make it available for others to download or extract (including as stock, templates, NFTs or in a competing library);
- use the Content in a way that is unlawful, defamatory, obscene, or that infringes another person's rights;
- register the Content, or any recognisable element of it, as a trademark, or claim to be its original author;
- use the Content to train, fine-tune or develop machine-learning or generative-AI models;
- use the Content in a manner suggesting endorsement by any real person or brand, or in sensitive contexts (see §7).
7. Nature of AI imagery
Content on Visbloom is generated using artificial intelligence. Any people, places, logos or objects depicted are fictional or synthetic and do not come with model or property releases. You are responsible for ensuring your use is lawful and appropriate. Do not use the Content to depict a real, identifiable individual, or in connection with sensitive subjects (e.g. health, politics, religion, sexuality) in a way that could be defamatory, misleading or harmful, without independent legal review.
8. Intellectual property
All rights, title and interest in the Service, the Visbloom name and logo, and the underlying catalogue remain with Miravio OÜ and its licensors. Except for the licence expressly granted in §5, nothing in these Terms transfers any intellectual-property rights to you.
9. Acceptable use
You agree not to misuse the Service, including by attempting to breach security, scrape or bulk-download the catalogue, circumvent the credit system, or interfere with other users. We may rate-limit, restrict or refuse service to protect the platform.
10. Disclaimers & liability
The Service and Content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud). Subject to that, our total aggregate liability arising out of or in connection with the Service is limited to the total amount you paid to Visbloom in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect or consequential loss. Your statutory rights as a consumer are not affected.
11. Suspension & termination
You may close your account at any time by contacting us. We may suspend or terminate your account if you breach these Terms or use the Service unlawfully. On termination, licences for Content you lawfully purchased and downloaded survive; unused credits are handled under the Refund Policy.
12. Governing law & disputes
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law rules, and subject to the mandatory consumer-protection laws of your country of residence in the EU. Disputes are subject to the competent courts of Estonia. Consumers may also use the options in our Complaints Procedure.
13. Changes to these Terms
We may update these Terms from time to time. The "Effective" date above shows the latest version. Material changes will be notified by email or on-site notice; continued use after changes take effect constitutes acceptance.
